Terms and Conditions

These Terms and Conditions ("Agreement") are established and enforced by DeltaTac, governing all transactions and interactions with the Buyer.

Agreement

These Terms and Conditions constitute the entire agreement between DeltaTac, Inc. ('Seller') and the purchaser of goods or services ('Buyer'), and supersede all prior agreements, representations or understandings between the parties relating to the subject matter herein.These terms constitute the complete agreement between parties. No modifications are valid unless in writing and signed by our authorized officer. If any provision is deemed invalid, the remaining terms remain enforceable.

Order Acceptance

All orders require written price verification by our authorized personnel. Shipment without verification doesn't constitute price acceptance.

Pricing

Quotes are valid for 10 days unless specified otherwise in writing.
We reserve the right to cancel orders if government-mandated prices undercut our quotes.
All prices are F.O.B. shipping point.

Shipping

We select carriers and routes at our discretion and aren't liable for delays or excess charges resulting from this selection.

Payment

Discounts apply to material costs only (excluding taxes/freight).
We may require advance payment if buyer's financial condition warrants.
Non-payment may result in order cancellation while maintaining buyer liability.

Title & Risk

Risk transfers to buyer upon carrier delivery.
Title remains with us until full payment is received.
Damage claims must be filed within 5 days with supporting carrier documentation.

Force Majeure

We're not liable for delays caused by:

Natural disasters
Government actions
Supply chain disruptions
Other uncontrollable events
During shortages, we'll allocate materials fairly among customers.

Legal Fees

Buyers agree to cover our reasonable attorney fees and collection costs for payment disputes or contract breaches.

Product Liability

We're not responsible for:

Application/use-related damages
Shipping errors unless claimed within 5 days with proper documentation.
Valid claims will be resolved via replacement or credit.

Remedies

Our maximum liability is limited to:

Replacing defective goods
Refunding the purchase price
Repairing products
These constitute the exclusive remedies for any breach.

Product Selection

Buyers confirm:

Goods are fit for intended use
No reliance on our selection judgment
Compliance with all installation regulations
Buyers indemnify us against misuse-related claims.
